If you are arrested for theft in Galveston it usually means you were accused of taking an item or items in excess of fifty dollars. Under fifty dollars is a class C misdemeanor and can be handled by a citation. The following is a list of the different levels of theft in Galveston County and the possible punishment associated with an arrest:
- $50-$499.00 is a class B misdemeanor carrying a possible fine and up to six months in jail.
- $500-1499.00 is a class A misdemeanor carrying a possible fine and up to a year in jail.
Most “shoplifting” cases are typically class B or class A misdemeanors. Often defendants make the mistake or trying to represent themselves in these matters thinking it is not an important matter. Some defendants try and see if they can just pay a fine. Although that may at times be a possibility we strongly advise against ever representing yourself in court and strongly advise against paying a fine because that would mean you were convicted. The most lasting and most devastating consequences of theft can be the mark it leaves on your background and the impact it can have on your future. It is a mistake to not fight the charges and hire an attorney to work hard to defend you.
c. $1,500-$19,999.99 is a State Jail Felony carrying a possible fine and between six months and two years in State Jail.
d. $20,000-$99,999.99 is a third degree felony carrying a possible fine and between two and ten years in prison.
e. $100,000.00-$199,999.99 is a second degree felony carrying between two and twenty years in prison.
f. Over $200,000 is a first degree felony.
