Can I expunge or seal a Theft from Houston?

    A theft can generally only be expunged if the case was dismissed or you were found not guilty in a trial.  There is one minor exception if it was a Class C theft case.  In order to be able to have your criminal history sealed you must have successfully completed deferred adjudication.  If you served jail time, were given time served or were placed on regular probation you are not eligible to have the case sealed or expunged.

    Please call to discuss your theft record in Houston, if you are eligible for an expunction it is a very technical matter and you are better off hiring a lawyer to draft and file the paper work.  If you are eligible for a non-disclosure the judge will decide whether or not to grant it and I have experienced first hand numerous situations where a judge was leaning towards saying no until we were able to present the proper information.
