Criminal Defense Attorney: Defending the Rights of the Accused and the Incarcerated

If someone is arrested for possession of cocaine and is sentenced to prison time they will come up for parole.  In most cases they will be eligible for parole after receiving credit for one quarter of their sentence.  An example of this would be if Sue was sentenced to four years.  She would be eligible for parole once her actual time in prison plus the additional good time credit she receives is equal to one year.  She will have this credit after being in TDCJ for less than eight months.

However, if the felony was increased under Health and Safety Code 481.134 involving drug free zones an offender is not eligible until serving five years, if the sentence is under five years they will have to serve the entire sentence.
